The CFTC begins the process of creating rules for high-frequency trading. Hopefully, a working definition of “high-frequency trading” will precede those rules. DB-NYSE Euronext send a sharp letter to European regulators, asserting that Joaquín Almunia’s recent comments are out of step with the legal case for their merger. Ratings agencies say that MF Global gave them a big thumbs-up self-assessment just days before the company exploded. France harvests negative predictions and opinions regarding its current plan to establish a transaction tax. And in banking news, the sector is awash in news about bonuses, how little they are compared to days of old, and at the same time how undeserved they seem to be.

A Modest Proposal For A Better Way For Regulators To Track U.S. Futures Customer Segregated Funds
John Needham
John Lothian has created a website where he is asking for users/registrants to add ideas for ways that the U.S. futures industry can recover from the collapse of future commission merchant (FCM) MF Global following the disclosure that hundreds of millions, possibly as much as $1.2 billion, of Customer Segregated Funds is “missing” from MF Global’s bank accounts. [...] John Lothian is asking for interested parties to offer ideas on how the U.S. futures industry can move forward after the apparent “disappearance” of millions of dollars of client funds. One of the ideas that was proposed was that missing client money should be restored immediately. That Suggestion Is Here. The original post was this:
“The number one priority: make customers whole… The number one priority to restore customer confidence should be to make the customers whole. Agree or disagree? No specific mechanism for making them whole is suggested here.
I concur with this idea and added the following comment:
I completely agree that the top priority is to make customers whole. I have had this argument with others and I do not buy into the “Slippery Slope” argument. I do not buy into the notion, though, that CME should make all the customers whole. Why not ICE, OCC, MGE, KCBOT too?

Wall Street loosens ties with CME rival ELX

The Wall Street powerhouses that founded ELX Futures LP to combat CME Group Inc ‘s virtual monopoly in Treasury futures are cutting their ownership stakes in the tiny exchange, where trading volumes were battered by last fall’s failure of MF Global Holdings. “We’re working on a new capital structure for ELX,” its new chief executive, Rich Jaycobs, told Reuters on Monday, in his first public interview since taking the job on Jan 20.

MF Global and the lie about safe accounts
David Weidner – MarketWatch
NEW YORK (MarketWatch) — It’s three months past bankruptcy. Do you know where your MF Global Holdings Ltd. money is? Neither does the firm. But for everyone who doesn’t have an MF Global account, can you really be sure that the brokerage account at your “safer,” more “stable” firm is any more secure? That’s the question many investors are, or should, be asking themselves after the revelation Monday that investigators fear most of the $1.2 billion in missing customer funds has disappeared from MF Global and its relationship accounts.

Three Chicago companies give back $34 million in tax breaks
By Hal Dardick – Chicago Tribune
Three Chicago firms, including one that secured a major state tax break with Mayor Rahm Emanuel’s support, are giving back $34 million in taxpayer funds, administration officials said Monday. CME Group, the financial exchanges giant that will save tens of millions of dollars a year because of the new state income tax break, is not accepting $15 million in special taxing district funds it was expected to receive.

Banks must reclaim their proper role
By Paul Tucker – Financial Times
Amid all the debates about reforming the global financial system, the two most important challenges are clear. The first is to return banking to its rightful place in a market economy. Banking should not depend on a safety net from taxpayers. Those who most espouse the disciplines of capitalism – bankers and financiers – should live by them. The second challenge is to take a much broader view of global finance than in the past.

Forget the big bonuses; a pay squeeze is coming
By Gillian Tett – Financial Times
Say the words “banker pay” to your average voter or politician and these days you will hear an angry hiss. [...] However, is it possible to imagine a world where banking pay – and banking – is radically slimmed down? Anybody living in countries such as Japan or Sweden would undoubtedly say “yes”; in those economies, foreign financiers’ salaries appear bloated. But perhaps a more interesting – and relevant – intellectual exercise is to peer at the US through a long historical lens; to imagine, if you like, a banking pay version of Back to the Future.
